NJ Bill S-3235 was recently signed into law by Governor Phil Murphy. This bill establishes strict regulations on intoxicating hemp products—like those containing Delta-8 THC, Delta-10 THC, THCA, and other hemp-derived cannabinoids—due to their potential intoxicating effects. The law now makes it illegal to sell these products to anyone under 21 years of age, and within 30 days, only licensed cannabis businesses overseen by the New Jersey Cannabis Regulatory Commission (CRC) will be allowed to sell them. The bill aims to close regulatory gaps around these products, which often were sold outside the regulated cannabis market, sometimes without proper testing or safety standards.

What This Means:
For businesses and consumers of hemp-derived products, this bill could severely restrict access to popular products that have been legally available under previous hemp laws. Small businesses and smoke shops that rely on these products are especially affected, as they now face significant regulatory hurdles and could lose a major revenue source.

Call to Action:
The community—including small business owners and consumers—needs to raise funds to challenge or amend this law. Legal challenges could be based on arguments like the Commerce Clause, which protects interstate trade, or lobbying efforts aimed at modifying the law to allow fairer regulations. A well-organized campaign could help fight for the rights of businesses and consumers who rely on these products.

Support is needed to mount a legal and advocacy campaign that could protect the livelihoods of local businesses and preserve access to safe, regulated hemp products.
