Melissa Hunter, originally from Decatur AL, is a Partner at Galloway, Wettermark & Rutens LLP. She moved to Mobile after graduating from The University of Alabama School of Law in 2008 to serve as a law clerk to Justice Sarah Stewart. Melissa earned her bachelor's degree from Birmingham-Southern College in 2005 in accounting. Melissa also serves as the Training Manager for the Junior League of Mobile.

Are your employees classified correctly? For an employee to be exempt from overtime, you must meet the DOL's exemption criteria. Here is what is not always understood... you must meet ALL of the criteria, not just one. Kathleen and I have more conversations with confused clients regarding exempt vs. non-exempt than any other topic.

Big penalty close to home... I don't know all of the facts in this (expensive) decision by the DOL, but I see that a manager was changed from hourly non-exempt to salary exempt but must not have met the DOL's criteria for exempt and according to them, is owed overtime. Now, typically managers fit under the executive exemption. Are they just titled as a manager and their job functions don’t meet the standard? Do they get paid below the threshold of $684 a week? I don’t know, but this got our attention….

The Equal Employment Opportunity Commission (EEOC) has announced the opening of its EEO-1 Reporting Platform on April 26, 2021. Covered employees are required to file both 2019 (postponed last year) and 2020 reports by July 19, 2021. The EEOC is giving employers 12 weeks, instead of the usual 10 weeks.

Summer is approaching and young adults are needed to fill temporary jobs. Many of us have fond memories of summer employment and count it as incredibly valuable experience.

Take a look at this DOL finding that fines a pizza restaurant for employing 17 year olds as delivery drivers. "Putting drivers this age behind the wheel to make 'as soon as possible' deliveries violates federal child labor laws." The details of this case is linked below.
