Today marks 5 years of our efforts to carry on the cigar bar tradition in Downtown Danbury.
We met with Mayor Mark at 11:30am on December 1, 2015.
When we sat down, Mark asked us what we wanted to talk about. Our answer was "253 Main Street."
Mark's immediate response was "I hope you want to put a cigar bar back in there!"
During that meeting we discussed the requirements and after reading THE STATUTE, Mark said we met the statute and urged us to purchase the building that was in foreclosure and get opened as soon as possible because this was just what Main Street needed.
Remember, Mark cut the ribbon at our Grand Reopening on August 25, 2018.... His Health Department revoked our Food Service License 6 days later with no notice, inspection, or order to correct. The statutes and regulations seem to require this.
Also in this meeting, we raised our concern that SEAN HEARTY would make an effort to prevent us from continuing as a cigar bar. The Mayor said that would not be a problem. We made sure that he repeated this reassurance and the meeting adjourned.
In fact, SEAN HEARTY DID MOVE TO BLOCK OUR EFFORTS. We have statements from other City employees that are consistent with the fact that Sean "rattled cages all up and down City Hall" to have our LEGAL CIGAR BAR EXEMPTION DENIED AT ALL COSTS.
Sean approached several departments including the Danbury Police Department. The local and state police have primary enforcement on indoor smoking as it is an infraction and only police can issue an infraction. The Danbury Police refused to intervene.
We also have statements from individuals that SEAN HEARTY has made statements about how "Kevin Paige will never have a cigar bar in that building" to both friends and officials from other towns in Connecticut. He has made these statements in both a professional and social setting.
While Sean was concentrating on eliminating our smoking, open Ho**ah smoking was happening at other city establishments and no action was taken against them. We obtained Health Department records for several years and found no enforcement like the closure we were subjected to.
The Mayor's refusal to talk or meet with us and failure to respond to multiple phone calls and emails speaks volumes to this issue.
We are calling on the Mayor, Common Council, CityCenter Board, other Danbury business owners, and others to step up and rectify this situation.
We are trying to bring an upscale clientele to CityCenter and rejuvenate our downtown. A cigar Bar is not for everyone, we recognize that. However, the fact that this exemption exists (we smoked openly for almost 4 months while Sean focused on closing us down) is something that any other downtown district in the state would salivate over. We were bringing in fresh faces and new money to our city and boosting business for other downtown establishments.
This has to stop.
