Last week, in a first, the FDA authorized menthol flavored va**ng devices and finally acknowledged the enormous body of science proving flavored e-ci******es help Americans quit smoking - not to mention FDA’s first authorization for a flavored disposable product at the highest ni****ne concentration available on the market.

The catch is that, to date, the only va**ng products authorized are those manufactured by Big To***co companies.

The second catch is that the week prior, FDA denied several other applications from small va**ng manufacturers and wants to keep their products off the market.

Why it matters: While the news is a tiny step in the right direction, it also reveals a more troubling pattern:

FDA is acting only in self-interest to quell political pressure rather than acting in the interest of the American people.

Approving some but denying other substantially similar products is going to bring renewed scrutiny on how FDA is arbitrarily applying its it’s public health standard which, to date, it has refused to clearly articulate.

The bottom line: The only v**es authorized today are all owned by the biggest cigarette companies in the world, demonstrating Brian King and the FDA’s hypocritical allegiance to those companies whose deadly ci******es and other combustible products the FDA continues to flood the market with at a record pace (more below).

Since the Sept. 9, 2020 submission deadline for PMTAs, the FDA has issued no marketing authorizations for any v***r products. So, the goal is to have everyone call 1-800-372-7181. A very nice switchboard operator will determine who your Rep/Senator is, and then you can let them know your thoughts. Literally takes a few minutes. Everyone can call once per day.

Talking points should be:
-SB344 Closes 450 v***r stores
-This does nothing for youth usage as gas stations and C-stores will continue to sell v***r products to minors
-450,000 adults use v***r products and many will go back to smoking
-Support amendment 2 on SB344 as this puts v***r products in age-restricted 21 and up businesses.
Or anything along these lines.
Keep the pressure up today! Tomorrow, there will be a vote in the Senate, and this will likely determine the fate of our industry. I feel like if Amendment 2 carries then not only will Big To***co and C-stores kill this bill in the House but it will also let Big To***co know that this amendment will carry on HB11...so they might go ahead and kill it also. This is the home stretch! Let's get to work!

It's crunch time.
HB11 is pending a Senate committee assignment. The absolute two most important things we should be doing right now are:
1. Try like hell to schedule meetings with your State Senator. This late in the session, the only way anybody is getting a meeting is by being a direct constituent. We have already spoken to several senators (many of them have indicated support), but we need to get face time with as many senators as we possibly can during this brief window we have left.

2. Keep pushing the QR codes! Make sure you are having customers scan the two correct codes. Upon scanning, it should mention supporting Amendment 2 to SB344. As SB344 and HB11 are companion bills to one another, we believe the fate of each bill is somewhat tied to the other.
