Family Of Philadelphia Meat Worker Who Died Of Coronavirus Sues Factory

The family of a Philadelphia meat worker is suing his employer after he died of the coronavirus.

Enock Benjamin, a Haitian immigrant, died of respiratory failure caused by COVID-19 on April 3 after working at a JBS slaughterhouse.

The lawsuit filed Thursday in Philadelphia Common Pleas Court claims the facility began ramping up production in March while forcing staff to work in cramped quarters without protective equipment.

“By choosing profits over safety, JBS demonstrated a reckless disregard to the rights and safety of others, including Enock Benjamin,” the lawsuit claims.

Benjamin’s lawyers are suing the company for wrongful death and negligence.

JBS did not immediately respond to a request for comment Thursday night.

The litigation appears to be the first of its kind within an industry where working conditions have allowed the coronavirus to thrive.

Plants across the country have closed, threatening the nation’s meat supply.

By the end of April more than 5,000 US meat and food-processing workers were infected or exposed to the coronavirus, while at least another 20 had died, the largest US meat-packing union said.

President Trump in late April invoked the Defense Production Act to deem meat plants essential infrastructure and signed an executive order to compel the facilities to remain open. Trump at the time said the order would shield the companies from liability.

“We’re going to sign an executive order today, I believe, and that will solve any liability problems,” Trump said.

Though Democrats had cast doubt on how far that liability would extend.

The suit alleges that JBS, a massive beef-processing company, has overseen COVID-19 outbreaks at least at seven of their meat plants across the country.

At Benjamin’s plant in Souderton, Pennsylvania, JBS added a “Saturday kill” shift in March to keep up with an increased meat demand. After the first worker fell ill with the virus, only workers who came “in direct contact with the individual for extended periods of time” were allowed to take off, according to the lawsuit.

The plant finally shut down for a cleaning after multiple workers became infected on March 27, the lawsuit claimed

“Despite the skyrocketing risk of COVID-19 infections for workers, the JBS Defendants ignored the safety of workers and required them to report for duty each day in cramped conditions and without adequate PPE,” the suit reads.

Where is my Stimulus Check?

For those who have not received your stimulus payment you are not alone.

There is a lot of mis-information being put out in the public that may have confused you. There are a lot of angry people who have been waiting for their payment and still have not received their payment.

Your frustration is warranted and is being handled as quickly and thorough as possible.

Some of us may have caused the delay in receiving payment from their own actions on non actions. Now don't beat me up I'm just trying to help in understanding the delay.

If you are a person who does not file taxes you have to register with the IRS through the NON FILERS portal On IRS.gov. in order to get your payment.

If you don't have a bank account, you need to register on the NON filers portal on IRS.gov. IRS needs to know where to send your payment

By not taking action can delay in your receiving your payment.

The best thing to do is go to IRS.gov and look to see where in your particular situation what category do you fall under and do whatever IRS asks you to do in order to get your payment.

ECONOMIC IMPACT PAYMENT INFORMATION / STIMULUS PAYMENT

Millions of Americans have already received their Economic Impact Payments (Payments) authorized by the Coronavirus Aid, Relief, and Economic Security Act (CARES Act). The Internal Revenue Service (IRS) continues to calculate and automatically send the Payments to most eligible individuals, however some may have to provide additional information to the IRS to get their Payments.

WHO IS ELIGIBLE TO RECEIVE STIMULUS PAYMENT?

A1. U.S. citizens and U.S. resident aliens will receive the Economic Impact Payment of $1,200 for individual or head of household filers, and $2,400 for married filing jointly if they are not a dependent of another taxpayer and have a work eligible Social Security number with adjusted gross income up to:

$75,000 for individuals if their filing status was single or married filing separately
$112,500 for head of household filers and
$150,000 for married couples filing joint returns
Taxpayers will receive a reduced payment if their AGI is between:

$75,000 and $99,000 if their filing status was single or married filing separately
112,500 and $136,500 for head of household
$150,000 and $198,000 if their filing status was married filing jointly
The amount of the reduced payment will be based upon the taxpayers specific adjusted gross income.

WILL RECEIVE A PAYMENT

For eligible taxpayers who filed tax returns for 2019 or 2018, they receive the payments automatically.

Those who don’t usually file a tax return and receive Social Security retirement, survivor, or disability benefits (SSDI), Railroad Retirement benefits, Supplemental Security Income (SSI) and VA Compensation and Pension (C&P) also receive automatic payments of $1,200. While some of these groups receive Forms 1099, many in this group don't typically file tax returns. Many people in these groups are expected to see the automatic $1,200 payments later this month, with SSI and VA payments expected to start in May.

For people who have little or no income and didn’t file a tax return or don’t receive any of the federal benefits listed above, they are also eligible for an Economic Impact Payment. They need to register with the Non-Filer tool on IRS.gov as soon as possible so they can receive a payment.

Vice President Mike Pence confirmed to reporters on Tuesday afternoon that the White House might look to close down the special coronavirus task force he’s been leading, possibly in early June.

Why, you might ask?

Well, there are a couple of explanations.

“It really is all a reflection of the tremendous progress we’ve made as a country,” Pence said. “The president stood up the White House coronavirus task force … to marshal a national response.”

“And as I’ve said before,” Pence continued, “as we continue to practice social distancing and states engage in safe and responsible reopening plans, I truly believe — and the trend lines support it — that we could be in a very different place” by late May or early June.

Fantastic. Except for those other reports that government predictions suggest 3,000 deaths per day by June, a 70% increase over the current daily tally, and a separate analysis suggesting the number of COVID-19 deaths nationwide could double to 135,000 by August. That comes as states — including California — begin loosening restrictions.

Then there’s the political explanation.

By closing down the task force, the White House would shift the visible responsibility for the fight against the coronavirus from the president to federal agencies, including the Centers for Disease Control, the National Institute of Allergy and Infectious Diseases (led by Dr. Anthony Fauci) and the Federal Emergency Management Agency, as well as to state governments and elected officials.

Doing so would position Trump to head into the summer — and the early scale-up of the fall election cycle — not as the near-daily host of the coronavirus task force update briefings, but as the president who handed off the problem to federal agencies.

He could then claim success if the pandemic does indeed die down, or run against those very agencies if the pandemic worsens or stages a rebound in the fall, as some experts suspect will happen.

He could then try to claim that he had the problem under control and the rest of the government messed it up. Yes, Trump is trying to angle himself to turn the coronavirus to his political advantage (nothing new there).

That would put Trump in his favorite role — as the aggrieved victim of the “deep state,” the entrenched government establishment and the “hostile press,” which in his view (or in his cynical lie to his base supporters) is in cahoots with Democrats to stifle the revolution he has been leading, and which stands in the way of his mission to “keep America great.”

That would give our dishonest president a platform from which to claim he needs to be reelected — to finish the job hardworking (and sometimes xenophobic) Americans sent him there to do. Namely, blow it all up … er, drain the swamp.

But what, you ask, of the health and the security of the American people?

Remote learning could replace the practice of a teacher standing in front of a classroom instructing students in the post-coronavirus area, Gov. Andrew Cuomo suggested Tuesday.

Cuomo dropped the bombshell while announcing a partnership with the Gates Foundation to “reimagine” education in the post-COVID era.

“One of the areas we can really learn from is education because the old model of our education system where everyone sits in a classroom is not going to work in the new normal,” the governor said at a press briefing Tuesday at his Manhattan office.

“And you do that all across the city, all across the state, all these buildings, all these physical classrooms,” he said. “Why? With all the technology you have?”

“When we do reopen our schools let’s reimagine them for the future, and to do that we are collaborating with the Bill & Melinda Gates Foundation and exploring smart, innovative education alternatives using all the new technology we have at our disposal.”

Cuomo in March issued an executive order closing school buildings during the pandemic and forcing educators to experiment with online or distance learning with students at home. He has since ordered that schools remained closed statewide for the remainder of the academic year to contain the spread of COVID-19.

The pandemic should trigger a willingness to adapt and modernize – albeit with providing the proper tech training and equipment for teachers and students, the governor said.

“It’s hard to change the status quo,” Cuomo said. “But you get moments in history where people say, ‘OK I’m ready. I’m ready for change. I get it.’ I think this is one of those moments.”

The teachers’ union and some education advocates reacted as if Cuomo dropped a nuclear bomb on their traditional, school building -based education system — and swiftly denounced his push for tech-based alternatives.

The New York State United Teachers union said in a statement: “NYSUT believes in the education of the whole child.”

The statement continued: “Remote learning, in any form, will never replace the important personal connection between teachers and their students.”

A coalition of education advocates immediately slammed the partnership with the Gates Foundation in a letter to the governor.

“Since the schools were shut down in mid-March, our understanding of the profound deficiencies of screen-based instruction has only grown. The use of education tech has its place, but only as an ancillary to in-person learning, not as its replacement,” the letter submitted by NYS Allies for Public Education, Class Size Matters and the Parents Coalition for Student Privacy said.

“Along with many other parents and educators, we strongly oppose the Gates Foundation to influence the direction of education in the state by expanding the use of ed tech.”

Remote learning has been problematic in New York City public schools.

The Post reported recently that live instruction had been abandoned in many virtual classrooms across the Big Apple — and the teachers’ union is backing members who choose to pull the plug.

Cuomo has been open to alternatives to traditional-based public education, particularly supporting the expansion of charter schools.
