Miles 'Mbappe' Sampa scores another goal against Lungu’s PF faction

MILES Sampa who equates his political mingalato to goal-scoring French machine, Kylian Mbappe has scored a vital goal against his PF opponents via a Constitutional Court decision that saw no constitutional breach in his expulsion of nine 'rebel' members of parliament.

After being expelled from the party, the nine PF lawmakers ran to the Constitutional Court arguing that Sampa had no powers to eject them from the party as that was in violation of the party constitution as he was illegally voted as PF president.

However, Constitutional Court President Margaret Munalula on behalf of her 10 other colleagues ruled that unlike interpreting the country’s laws, the powers of the Concourt do not extend to commenting on violations of political party constitutions.

She said the Concourt’s powers are limited by the constitution itself and enabling statute, to clarifying the law of the land as specified in Article 128.

In this case, Ronald Chitotela, Nickson Chilangwa, Musonda Mpankata, Christopher Kang’ombe, Remember Mutale, Brian Mundubile, Stephen Kampyongo, Mulenga Fube and Mutotwe Kafwaya had petitioned Miles Sampa, Morgan Ng’ona and the Attorney General over their expulsion from the party on reasons that Sampa’s ascendancy to the presidency of the PF is illegitimate.

The nonet argued that Sampa was expelled by Edgar Lungu’s illegal vice-president Given Lubinda for misconduct before he held an illegal convention on October 24, 2023 where he was elected as PF president.

They said procedure was not followed prior to the convention being held, as Sampa had no blessing from the central committee.

Chitotela and eight others sought an interim order allowing them and their camp (Lungu Faction) to operate freely and that Sampa and Ng’ona should stop carrying themselves as leaders of the party.

Sampa filed a notice of motion to raise Preliminary Issues on a point of law on reasons that the petition was incompetently before Court.

He said some of the reliefs in the petition were aimed at instituting a backdoor judicial review of the decision of the Registrar of Societies to effect changes on the list of office bearers for PF which is a subject matter in one of the many cases before the High Court.

Sampa stated that the petition sought an injunction which has already been denied by the High Court in cause no.2023/hp/1866.

He said the petition is amateurish as it invites the court to deal with issues relating to his elective conference which are pending determination before the High Court under case no.23/hp/1866 and 2023/HB/ 77.

Sampa said the issues deal with private rights of individuals in a political party which is similar to a club.

However, the Court said the petition does not show how Article 60(2) of the Constitution of Zambia (Amendment) Act No. 2 of 2016 has been violated, as the said Article is merely quoted in a blanket manner to make the case appear like a Constitutional issue when in fact it involves the private rights of individuals in a political party, which is the purview of the High Court.

“The issue raised in 4(v) of the application goes to the jurisdiction of this Court. Sampa and Ng’ona in their application contend that the Petition does not disclose how Article 60(2) of the Constitution has been violated,” she said

“Further, that it does not disclose any Constitutional issue for determination by this Court and therefore that the Court has no jurisdiction to entertain the Petition in its current form.”

Professor Munalula said in the case of
Benjamin Mwelwa versus The Attorney General and Others, the Concourt noted that jurisdiction is what provides the authority for a Court to hear and determine matters that come before it in the manner prescribed by law.

“If the Court was to proceed to hear and determine this matter, the resultant judgment would simply be a nullity,” she said.

Professor Munalula said other issues would serve no purpose upon establishing that the Court has no power to determine the petition which does not border on constitutional issues.

“Sampa and Ng’ona’s application to disgorge petition for want of jurisdiction is upheld. The Petition herein is hereby dismissed,” said judge Munalula.

She ordered that each party bears their own costs.

JJ was hallucinating when he told police I abducted him - Hamasaka

State House communications specialist Clayson Hamasaka has vehemently denied the bizarre allegations leveled against him by Petauke Central MP Emmanuel JJ Banda.

Banda, who mysteriously vanished on the morning of May 25 only to reappear two days later, claimed that Hamasaka, along with Levy Ngoma and Trevor Mwinde, abducted and brutally tortured him, even going so far as to pull out one of his testicles.

Hamasaka has reacted with disbelief and shock saying he has never even laid eyes on Banda in person.

As the police investigation struggles to gain traction, the truth behind Banda's disappearance remains shrouded in mystery.

In a letter sent to Banda's lawyer, Makebi Zulu, Hamasaka's lawyers, Mweemba advocates dismissed the allegations.

Hamasaka's lawyers said Banda may have been hallucinating and not in a proper state of mind when he made these claims.

The lawyers Emphasized that Banda and Hamasaka have never met, making it impossible for Banda to have identified Hamasaka as one of his abductors.

He described Banda's allegations as "spurious" and threatened to take legal action against him for defamation, seeking damages of at least K10 million.

An investigation has been launched to ascertain what caused the accident where a contractor was fatally electrocuted, while working on a 33 KV overhead power line within the Nakambala Estate in Mazabuka.

Zambia Sugar Corporate Affairs Director Eugene Chungu has also announced that the company will this Wednesday resume Production operations which were suspended on Tuesday following the fatal electrocution of the named third party contractor.

"All company production operations have been halted and a safety stand down was undertaken by all employees and contractors across the various sites," reveals Chungu.

"The Company prioritizes the safety of all its people above all else and will continue to review and enhance safety procedures surrounding all work assignments including energy isolation."

Zambia Sugar has since sent its condolences to the family and friends of the deceased and has offered its full support to them.

Meanwhile, the World Environment Day celebration which was slated for Nakambala Estate has now been moved to St Edmund's Secondary school in view of the incident.

Singer Sean Kingston has been arrested in California, hours after a police raid of his Florida mansion, during which his mother was also arrested.
Mr Kingston was accused in February by a company of not fully paying for a huge TV and sound system.
He was taken into custody in Fort Irwin, southern California, on fraud and theft charges on a Florida warrant, police in the latter state said.
In an earlier social media post, Mr Kingston said his lawyers were "handling everything".
The Florida police raid targeted a residence near Fort Lauderdale at which the singer - whose legal name is Kisean Anderson - was named as living in court documents from February.
US media - including the BBC's partner CBS News - reported that the woman arrested was Mr Kingston's mother.
Confirming the raid to the BBC, the Broward County Sheriff’s Office said it served arrest and search warrants at the property.
"As a result of the investigation, an adult female, Janice Turner, 2/16/1963, was taken into custody on numerous fraud and theft charges.
"This investigation is active and ongoing."
Officers were reportedly seen taking goods away from the house afterwards. It was not immediately clear whether the arrests were linked to the company's allegations.
Mr Kingston's own arrest hours later in southern California was "without incident", Broward police said. Mr Kingston was due to be booked into jail in San Bernadino.
Mr Kingston and his mother, known on Instagram as Mama Kingston, have been asked for a response.
Before his arrest, Mr Kingston appeared to address the developments on his Instagram account.
"I am good and so is my mother," the singer said in response to reports that the arrested woman was his mother.
"My lawyers are handling everything as we speak," he added.
A lawyer representing the pair acknowledged that allegations had been made against them, telling the AP news agency: “We look forward to addressing these in court and are confident of a successful resolution."
