Chicago academic record: Tinubu’s lawyers kick as court orders release

The United States District Court in Northern District of Illinois has ruled in favour of the presidential candidate of the Peoples Democratic Party, Atiku Abubakar, and ordered the Chicago State University to release President Bola Tinubu’s academic record by Monday (today).

But Tinubu’s lawyers insisted that the documents would not be relevant in Atiku’s appeal against Tinubu at the Supreme Court.

P&C NEWS PLATFORM reports that Atiku had earlier secured an order from a US magistrate for CSU to make Tinubu’s academic records available to his legal team.

The magistrate, Jeffrey Gilbert, had ordered Tinubu’s alma mater to provide all relevant and non-privileged documents to Atiku’s legal team within two days.

The documents sought by the PDP candidate, through his counsel, Angela Liu, include Tinubu’s record of admission and acceptance at the Chicago State University, dates of attendance as well the degrees, awards, and honours obtained by Tinubu from the CSU.

But as the deadline given by the magistrate drew nearer, Tinubu’s lawyers approached the US high court, arguing that the earlier decision by the magistrate needed to be reviewed by a district judge.

The request for a review and delay of the magistrate’s order till Monday was eventually granted by the US district judge.

Tinubu’s application, filed by his New York-based lawyer, Oluwole Afolabi, advanced two reasons.

First is that his academic records in issue are not useful in Nigerian courts as claimed by Atiku because “the Nigerian election proceedings and the Nigerian courts have explicitly been unreceptive to the discovery.”

His second reason is that Atiku’s request “is unduly intrusive because it allows the applicant (Atiku) to conduct a fishing expedition into the intervenor’s private, confidential, and protected educational records.”

The former vice president in a fresh response filed last Wednesday, in Chicago, Illinois, charged the court to overrule Tinubu’s request in its entirety.

In a fresh judgment obtained by Newsmen on Sunday, Maldonado noted that CSU did not object to Judge Jeffery Gilbert’s decision that the academic record be made public.

The court held that Atiku’s interest outweighs any intrusion on Tinubu’s privacy interests in his educational records.

The judge overruled Tinubu’s objections to the ruling by the magistrate ordering CSU to make his academic records available to Atiku.

Judge Gilbert also adopted the magistrate’s ruling in full.

The memorandum opinion and order read in part: “For the foregoing reasons, the court overrules President Tinubu’s objections to Magistrate Judge Gilbert’s recommended ruling, and therefore, adopts the ruling in full.

“Mr Atiku’s Application is, therefore, granted. In light of the pending Supreme Court of Nigeria deadline, represented to the court as October 5, 2023, and based on CSU’s representations that it is ready to comply with the discovery requests and produce a witness, the court sets an expedited schedule for completion of discovery.

“Respondent CSU is directed to produce all relevant and non-privileged documents in response to Requests for Production Nos. The Rule 30(b)(6) deposition of CSU’s corporate designee must be completed by 5:00 p.m. CDT on Tuesday, October 3, 2023. Given the October 5, 2023, filing deadline before the Supreme Court of Nigeria, the court will not extend or modify these deadlines.

However, the judge stressed that his verdict “is expressing no view on the merits of Mr. Abubakar’s underlying claims regarding President Tinubu or his graduation from CSU, or on the validity of the Nigerian election. Nor is the court taking any position on what any of the documents or testimony from CSU may or may not ultimately show.”

“The court simply finds, on the narrow question before it, that Mr Atiku is entitled to the production of documents and testimony that he seeks from CSU,” he said.

Reacting to the verdict, a member of the PDP National Executive Council, National Deputy Youth Leader, Timothy Osadolor, described President Tinubu’s appeal as a needless route.

Osadolor, in an interview with Newsmen, said “If he was convinced that has had nothing to hide, there was no need for those appeals against the courts.”

According to him, the US judgment will reinforce Atiku’s appeal before the Supreme Court.

“Tinubu is not who he claims to be and that is what our candidate and our party want to prove.”

Efforts made to reach the spokesman for the All Progressives Congress, Felix Morka, were unsuccessful.

Meanwhile, one of the President’s attorneys, Oluwole Afolabi, has played down the importance of his academic documents, saying it will be of no use in Atiku’s Supreme Court appeal in Nigeria.

Reacting in a WhatsApp note published on Sunday by PM News, Afolabi stated that the Electoral Act does not allow for the introduction of new evidence on appeal.

“A party must provide a list of the documents he intends to rely on at the time his petition is filed. A party cannot spring a surprise on his adversary by introducing evidence that was not filed along with the petition,” Afolabi said.

Similarly, the Coordinator of the Tinubu Presidential Legal Team, Babatunde Ogala (SAN), said, “The documents can no longer be used. It is of no value. We have passed that stage.”

“One is whether President Tinubu attended Chicago State University. The answer is yes. Second, what were his grades in school? The school had already provided that,” Ogala said.

Nigeria on IF and only IF...

As Nigerians, we know a lot of things happening not to be true, but we turn a blind eye, hoping for someone else to help the situation instead of us individually..

Regrettably nothing works in Nigeria.
Corruption as we know it, is a bonafide citizen of Nigeria, or we can say is the Number 1 (one) citizen of Nigeria.

As a country , we do not have a website, or a page that tracks down everything about the country. The citizens throw so much blames on the leaders, yes because they have been elected to lead.

But is it really the choice of the people who are in power?

Let's move on to reality.
No working economy, as Nigeria can't even provide jobs for it's citizens. The Educational system is dropping so fast because people are preferred to know less than the usual, because the control system want people to remain clueless of what it is , and what it's not.

The defense system is worse, so there is only oppression , the legal system is bribed , so the there is no rule of law to everything and everyone. Just the rich paying for the poor to remain exactly where they are, or worse.

We need to know. We need to grow, we need it more than ever, and we need it now.

GREAT LESSON OF THE DAY👌

In 1990, Shina Peters built a house with N20 million naira; the same year Jim Ovia started Zenith Bank with the same amount.

Today, you and I don't have a room in Shina's house but I have an account in Jim's bank and probably you do too.

Shina's house was built in Iju Lagos and remains there till date.

Jim's bank started in a corner and now has over 500 branches in Nigeria, and many international branches.

Millions upon millions transact business in Jim's bank daily.

Shina's house is becoming dilapidated...in 2015, he SPENT more money to renovate the house and bought a Nissan Pathfinder with N10 million...additional liability, while in the same 2015, Jim's bank MADE a profit of N105.7 billion.

Zenith bank employs hundreds of thousands, and feeds their families.

This is the difference between Assets and Liability. If you buy a car for N20 million today, in 20 years time, you will be ashamed to drive it.

On the other hand, if you invest that same amount in a lucrative business or in an asset, It may be worth billions in 20 years. ( Jim Ovia is now worth $980 million dollars, with the official dollar rate of N320, that means he is worth N313 BILLION NAIRA because of an investment of N20 million).

Spend the little money you have today wisely. Some people driving expensive cars today, are not aware that they are driving their future and the future of their children.

Some people carrying iphone7 today, may not be aware that they are carrying their future.
When you are young, don't spend money. Invest it.

Every penny in your hand is like a seed, you can decide to eat it, or sow it. When you sow it, it will bear much more seeds later in future.

Day by day, it is becoming very obvious why Nigeria as a nation needs His Excellency Peter Obi as her president.

Anyone who stands as a critic to his running as a presidential candidate, is an enemy to progress and development.

Majority cannot be doing a mistake for so long, when we all know exactly what we're passing through. And how it can be corrected.

We don't need payments, or personal benefits, all we need as a nation is progress in development, progress in production, progress in mass in every area of the economy at large.

We have taken enough from our previous leaders and current leaders, who have lead us no where but to a part of poverty, and the lowest standards of living.

We're taking the bull by the horn this time around. And we're going all the way to the finish line.

Campaigning has now started fully in Nigeria. There are a lot of lies to be fed to the citizens of Nigeria from these political parties and individuals who are in it to gain monetary compensation.

What we should all bear in mind is the fact that this time it wouldn't work as it used to. Maybe it would have be possible if a little bit of development and growth was done during the tenure of the APC, but that is not a story we like to talk about . Because the didn't just fail us, but they actually believe they've been good and we should be grateful. What a pity to the ruling party.

Meanwhile, PDP brought out the blueprint for the manifestation that has almost brought this great nation to its knees. We can't take more of these lies, and corruption processes been labeled as good leadership.

Nigerians are not voting for Labour party, but the individual who is coming to represent that party. Peter Obi has said what he wants to do. We've listened and are ready to follow him, not because he pays us to, but because we are ready to use our private and little resources to make a stand, that is known to many of us as the last stand. There is no way out , if we don't get this done by 2023.

Whomever supports APC and PDP has something to gain, because he or she has been paid, or will be paid at the end of the day.

This isn't one of those times for most of us Nigerians. All we are saying is that, enough is enough. And we want a total change of power, and this is what we stand for. You don't have to like it, but that is our stand as Nigerians.

The students, children and youths of Nigeria are the victims of the the federal government and Assu as a body.

There is no pity or concerns for the growing unrest happening in the country. Students sitting at home , can't learn, no way forward, and no clear vision from the government.

When these happenings create a mind of criminality in the fragile and growing minds of children who are supposed to be guided and controlled by the government and assu , then it becomes a problem to be solved.

We thrive above all odds, even when we're supposed to suffer, we thrive.

This is as a result of the resilience we have as a people. But we've thrived in poverty for far to long. And it is a time to take the bull by it's horn.

Let us set ourselves ready and make a change, a change that can turn the odds in our favor.
A change that can turn the tides in our favor, a change that will set us in the right part.

Let us breathe a new air from freedom from terror, freedom from abductors, freedom from political criminals, freedom from police oppressors, freedom from gangs and freedom from poverty.

A young man and a young woman gets into the university, with the aim of graduating and getting a good job, to take care of their needs, their families and immediate environment.

That's the idea, but in Nigeria, that idea is almost dead, because people would say school now SCAM!
This is as a result of a failed leadership system that has been in existence since when we can remember.

My mom once told me, that back in the day, after graduation, you'd be given a car, and there was always job everywhere you looked. That was the momentum I had when I decided to go through school, and make something off myself. But I guess that dream is dead for Nigerians at this time.

The president has come out on two different occasions to tell Nigerians that no matter the certification you get in Nigeria, there is no job.
With that coming from the president himself, it kills the drive of education in our society.

I don't expect more from an old man, who should be retired and staying home with his grand kids.

EFCC was created for the looters in Nigeria, but they've turned themselves to hunting of young men who are doing whatever they can savage to feed themselves and their families.

Enough is enough, we should learn from this current government, not to give old men, of the age of our grandparents, the responsibility to hold a nation which is almost dead, because they cannot help us.

Vote a younger man, with ideas that can turn the future for the better. Nigerians we should and must change the faith of this nation. Please we should all come out to vote.

A lot of APC and PDP supporters are angry and surprised about the massive support of Peter Obi from the LABOUR PARTY.

This shouldn't come as a surprise because, the track record from the two supposed elite parties as worse than an earthquake storm that can hit a nation never to rise again.

If not for the inner burning fire from Nigerians, it would have been a disaster. It hasn't been that because Nigerians are fighters.

But come 2023, it's a fight for our lives and future. Let the support keep on ravaging the minds of every other political party.

They say different I'll things because they are scared and never have seen this type of support. But we know their plans and will never fall for these tricks at all.
